Florida Eliminates Statute of Limitations On Child Sex Abuse Cases

Child sexual abuse victims in Florida received historic good news on May 11, 2010, when Governor Charlie Crist signed into law Florida House Bill 525 which eliminated the statute of limitations on both criminal and civil claims relating to children under the age of 16.

The new law goes into effect and applies to any claim that would not have been barred by the existing statute of limitations as of July 1, 2010.

The main opponent lobbying against the new law was the Catholic Church.

This significant change in the course of Florida law allows abused kids to hold their abusers accountable for all of the damages that they haved caused.  Since the psychology of child sexual abuse many times leaves victims unable to comprehend or even remember the abuse for many years after it occurs, the new law will help eliminate the injustice inherently associated with child sexual abuse.

We've brought a girl into our home that just turned 18 that was being taken care of by a family friend (had guardianship). She was sexually abused by this man beginning age 15. The girl has never cooperated with authorities because somehow this man has threatened her. He has also told her when you turn 18 all charges will be dropped. I contacted the sex crimes unit in Homassassa/Inverness The detective I spoke with called this predator a "knuckle head" and said "well mam, she was a willing participate" there was also another girl that refused to testify as well. I've been told by the girl that drugs and alcohol were always involved. She has been unwilling to open up to me, and quite frankly she lies. But there have been attempted charges filed or a case. I know this is on her mind because she said the other day when she turned 18 I need to find out if Brady is in jail.My concern is that this man was living with another woman that had a small child. Can you give me some advice?

Can you tell me what the limitations were 35 years ago? Just found my first foster sister and have had alot hit me hard all at once. Haven't been there in a long time and now is it too late to go after this man? I'm in Brevard county (the violations took place there from 71 to 76, how can I found out what the laws were then? Went to local library site and they directed me to a couple of sites like yours. Any help would be greatly appreciated. Thank you, Cheryl Rodziczak
