Prospects For Justice Limited in Wrongful Death of 19-Year Old DeLeon Springs Man

The Daytona Beach News-Journal is reporting the tragic death of a 19-year old DeLeon Springs man in an automobile versus pedestrian accident that occurred at Hagstrom Road and Highway 17,  just outside of Pierson, in Volusia County.

Apparently, the young man from DeLeon Springs had been involved in a previous crash, and was waiting at the crash scene with the other driver for help to arrive.  As they waited, the young man either stood or walked on the shoulder of the road.

At about that time, Jaime Rios of Deland, was southbound approaching the scene where both of the previously damaged cars were stopped.  For reasons that are still unknown, Mr. Rios apparently could not avoid the young man, struck him with his 1992 Dodge Dakota, and tragically killed him.

To make matters much worse, the News-Journal is reporting that Mr. Rios was driving without a drivers' license.  This is not a good sign.  Not only is driving without a license obviously illegal, but as an Orlando area accident attorney, it has been my experience that folks who drive without a drivers' license very rarely carry bodily injury liability insurance to compensate the people they injure.

The loss of a young person is always the worst.  Our thoughts and prayers go out to the young man's family.  I am going to keep my fingers crossed that the young man's family had the foresight to purchase Uninsured/Underinsured Motorist coverage so that some kind of compensation might to had to address the young man's medical bills and other expenses related to this tragedy.
