Red Light Cameras Become Legal Throughout Florida

Governor Charlie Crist brought some uniformity across the state of Florida when he recently signed into law a measure legalizing red light cameras across the state.

Beginning on July 1, 2010, all cities and counties in Florida are free to install red light cameras and begin issuing citations by mail to those drivers captured by still photograph running red lights.  The citation will feature a fine of $158, of which $75 will go to the local government and $83 will go to the state.  Out of the state's portion will be carved out $10 for health care, and $3 for the Miami Project to Cure Paralysis.

As I have previously written, the measure is expected to raise $29 million for the state of Florida this year, and as much as $95 million per year by 2014.

Vehicle owners will have to pay the fines unless they can prove that someone else was driving their vehicle, or that they were order by a government official to drive through the intersection.

Personally, I am torn about this law.  While I am very much in favor of any measure that will make roadways safer for my family, I also dislike the Big Brother-type mentality that remote cameras placed everywhere seem to convey.  How do you feel?

Dahna: Presumably a photo taken when the light was still yellow would demonstrate that, and would be an easy out of the ticket. Similarly, if the person was so close as to be a danger when you entered the intersection, it would seem that that would be demonstrated in the photo, and give you another "out" of the ticket.

Slamming on brakes is more difficult issue. The law does require you to yield at yellow, and to stop at a red light. If you are stopping at a red light and get rear-ended, then the fault likely lies with the driver behind -- as he has a duty to stay a safe distance behind you. However, the sole defense in a rear-end accident is a sudden and unexpected stop. So if your slamming on brakes to avoid a red light camera fine was "sudden and unexpected" to the other driver, you might be found at fault.

It is a definitely a confusing area. I believe we will see some more legislative and/or court activity on red light cameras in the near future.

Here is my big problem with this. 1) I see the cameras flashing when people go thru on the yellow ALL the time. 2) Also, if the person behind you is speeding and/or on your bumper, you'd be wise to go thru the light. I have avoided several accidents this way. 3) How can you prove that someone else was driving your car in those instances when someone else is actually driving your car? 4) What happens when people fear getting citations and slam on their brakes?
