I read with interest this recent piece on Channel 9's website regarding drama at a traffic hearing in Brevard County. The story began in September 2009 when Deputy Vincent Marino-Vitani ran into and killed pedestrian Henrietta Strong on his way to work on State Road 520. According to law enforcement investigation, Deputy Marino-Vitani was late for work and was travelling 64 miles-per-hour in a 40 miles-per-hour speed zone. Accordingly, the deputy was cited for exceeding the speed limit.
At the same time, he was not cited or charged with causing Ms. Strong's death, as investigating officers determined that Ms. Strong stepped of the curb and into the deputy's lane of travel.
Despite not being charged with causing the woman's death, apparently Deputy Marino-Vitani has also lawyered up and wants to fight the speeding charge. Quite understandably, Ms. Strong's family is furious.
As a car accident attorney who has handled his share of Brevard accident cases, I wish I knew more about this story, but apparently I'm coming in late. For instance, I would like to know how an initial investigation determined that speed played no part in Ms. Strong's death. Obviously, going 24 miles-per-hour over the speed limit is going to drastically reduce the deputy's ability to observe hazards, react to them, and potentially control his vehicle enough to avoid the hazard.
I'm also curious as to the energy put into this fight over the speeding ticket. The family surely knows (after having hopefully spoken to an experienced personal injury lawyer regarding this pedestrian versus automobile accident) that the traffic ticket is irrelevant and inadmissible in civil injury case. I would also think that the deputy would see some logic in paying the ticket and moving on without causing additional pain and rancor for this family.
