Uninsured Motorist Benefits May Help Family In Fatal I-4 Truck Accident

Several Central Florida media outlets have reported about a box truck accident that occurred on Interstate 4 near Lake Mary in Seminole County.  Apparently, a 24-year old Apopka man was killed when the truck he was driving loaded with flowers and plants crashed into the median guard rail of I-4.

According to the investigators, the Apopka man was driving eastbound on I-4 in the center lane when a vehicle entered the highway at the Lake Mary entrance ramp at a high rate of speed.  The truck driver veered to his left to avoid the faster vehicle, lost control, and hit the guard rail where his vehicle overturned.

As an Orlando accident attorney who has seen more than his fair share of tragedies and wrongful death just like this one, my heart goes out to the Apopka man's family.  I have sat with families as they have tried to make sense of a situation like this one - where the family will likely never know the identity of the speeding vehicle that may have ultimately been the cause of this crash and their loved one's death.

Many people do not realize that Uninsured Motorist benefits may be available in a situation like this one - even when the identity of the offending vehicle is not known (also known as a "phantom vehicle"), and where was no reported contact between truck and speeding car.  However, many insurance policies contain language that place a very short reporting window upon claimants.  For example, I have seen a policy that required an insured to report an accident like this one within 24 hours, or forfeit coverage.  I hope the Apopka man's family has spoken to somebody about this, and gotten some good advice.
