A: In most instances, the negligent party in an accident will be covered by liability insurance. Although it may appear on the outside that you are making a claim directly against the negligent party, in reality the insurance company is calling all of the shots. The insurance company is deciding whether to settle the claim, and how much to settle the claim for. Additionally, the insurance company will hire an attorney to represent the negligent party, and will call all of the shots regarding the attorney's actions during the case. Most cases will settle, but only if the negligent party's insurance company decides it wants to. Insurance companies have a legal duty to protect their customers' best interests. Therefore, if the insurance company is doing its job properly, claims should be resolved without ruining anyone's life.
