Q: I've tripped and fallen and I'm hurt. What should I do?
A: If you've been injured on someone else's premises, the first thing to do is the report your injury to the property owner or manager. Ask if you can file or submit something in writing, and ask if you can keep a copy. If possible, take photographs (a camera in your phone is perfect for this) of whatever the condition is that made you fall. If any witnesses saw you fall, get their names and good contact information. Last, ask the owner or manager to preserve any surveillance video footage that may show your fall. Trip and fall, or slip and fall, injury cases are some of the most difficult cases to make recoveries on. Many times defendants will deny that an accident happened at all. Without proof, they will often imply that the injured person made the whole up.
You may also want to visit an emergency room or urgent care center in order to be evaluated. In most cases the most convincing evidence that we have that our client was truly injured in a fall is our client's medical records.
